By using any pages within this site you expressly accept and agree to abide by all the terms and conditions in this legal statement. These terms and conditions may be updated in the event of other products or services being introduced into Cubesedge.

The site is available only for your personal use, which shall be limited to viewing, downloading product and service information, purchasing products (print and electronic imagery), communicating during project progression and receiving the latest updates from Cubesedge.

Your use of this site and any dispute arising out of such use is subject to the laws of England and Wales.

To the fullest extent permitted by law, we are providing this site and its contents on an “as is” basis and make no (and expressly disclaim all) representations or warranties of any kind, express or implied, with respect to the site information, content, materials or products including, without limitation, warranties of merchantability, quality and fitness for purpose.

In addition, we do not represent, or warrant that the information accessible via the site is accurate, complete or current, and that the services provided will be uninterrupted and free from errors. Cubesedge will accept no responsibility for any harm to computers and peripherals incurred by using the site.

We reserve the right to change product and service costs without prior warning.

This website may also include links to other websites. These links are intended to provide further information for you and don’t signify that we endorse the sites or accept responsibility for the site contents.

We reserve the right to suspend, limit, or terminate your access to the site for any reason.

Payment.

All prices shown are inclusive of VAT at 20% if you are within the EEC, or without VAT if you are purchasing from the rest of the world.

Print Sales,Exclusive Licensed Images and Communication Print.

When importing goods to the USA, Canada , Australia and New Zealand duties and taxes are liable to the customer, and will not be paid for by Cubesedge. Further, Cubesedge are not responsible for Custom Clearance charges. Specifically, when importing to the USA you may be required to supply your Social Security Number in order for your goods to clear customs.

If purchasers outside the UK decide to cancel an order Cubesedge accepts no liability for devaluation of refund as a consequence of currency exchange rate fluctuations.

Payment in full must be made over the internet prior to prints or electronic images being dispatched, all major credit and debit cards including Visa, Visa Electron, Mastercard, Maestro,American Express and PayPal are accepted.

You will receive confirmation of your order via email on receipt of payment.

Services.

Payment for: Photography - to be made within 30 Days of invoice date,images can not be used until payment is received.

Graphic Design - A payment of 50% of the estimate is required prior to work commencing.The completed designs will be available electronically on receipt of payment of the outstanding balance.

Web Design - On return of a signed copy of the Terms & Conditions submitted with the proposal an interim payment of 50% of the estimated project cost will be required prior to project progression. Upon project completion, the client will be invoiced for the outstanding balance, payment required within 30 days from the date of invoice after which the website will be transferred from the test to the live environment.

Exceeding invoice payment dates.

Late payments will incur an administrative charge of £75, if the balance is not paid in full within an additional 60 days, a credit management company will act on Cubesedge’s behalf. In the event of the client withdrawing from the agreement, Cubesedge will invoice for all completed parts of the project, payment required in full within 30 days of the date of invoice.

Ordering and Shipping

Prints unmounted and mounted will be dispatched in acid free robust tubing or stiffened card supports respectively, within 7 working days.

Framed Prints will be dispatched using our own strengthened packaging system within 21 working days.

Unmounted and mounted prints dispatched to UK destinations will be sent via
Royal Mail Recorded Delivery and dispatched worldwide via UPS.

Framed Prints dispatched to all destinations will be sent via UPS.

For insurance purposes a signature will be required on receipt of your delivery.

Returns

In the unlikely event you are unsatisfied with your photographic or design print, or damage in transit occurs,please contact us within 7 days of receipt. Providing the print is returned in the original condition, or ‘as found’ in the latter case taking all precautions to ensure further damage is not incurred during transit, within 21 days, we will process your return and send you an e-mail confirming your refund. Refunds on credit cards can be expected within 5 working days, refunds on bank statements may not show up immediately, please note that the monies may take up to 10 working days to appear in your account dependant on your bank.

Cubesedge are not able to accept responsibility for any returns lost or damaged in transit and recommend all returns are well packaged and sent by registered post. It is advisable to obtain a proof of posting certificate and arrange the necessary compensatory cover for the items.

All orders for prints can be cancelled at any time up to the dispatch of the item. If you wish to cancel an order contact us immediately within the dispatch period, if we have not dispatched the item we will cancel the order, we can not accept responsibility for products that have already been dispatched from our distribution centre.

Product or Service Specific

Exclusive Licensed Images.

In order to download exclusive licensed images and designs (the Content) from Cubesedge, in addition to abiding by the general terms and conditions, you must agree to the following specific terms and conditions. If you are accepting this agreement on behalf of a company, you represent and warrant that you have complete legal authority to bind the company.

If you dont accept or agree with these terms, or don’t have the authority from your company, do not download the Content.

The exclusive licence gives you sole use (with the following prohibitions) of the Content worldwide in any media type for 1 year from the day Cubesedge has received full payment. 7 days before expiry of the licence Cubesedge will contact the client by e-mail with the option for renewal of the license for 1 additional year. Cubesedge reserve the right to withdraw an image at the end of an expiry period. The client will be notified no later than 7 days prior to expiry in such instances.

Exclusive License Prohibitions.

Use the Content in any items for direct resale (eg. For posters, T shirts) or distribution for profit.

Sub–License, end or re-sell the content.

Use the content in editorial format without crediting ©Cubesedge.com alongside the Content.

Graphic Design.

On return of the e-form, our design department will assess the amount of work required and prepare a quotation. On confirmation by the client to proceed, the client will be requested to login to our secured members area (privacy policy) and we will communicate Key Visual design versions through our interactive editing suite. Changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to an additional charge. Cubesedge holds no responsibility for amendments made by a third party, before or after a design is published. On approval of the design, the client will be invoiced and given access to download the design.

Web Design

Following an initial consultation, a proposal and quotation will be prepared and sent by email.

The project will commence on the return of a signed copy of the Terms and Conditions(located at the back of the proposal),along with an interim payment of 50% of the estimated project cost.

Client approval is required at the project outline, design and testing phases prior to progression. The outstanding balance of 50% will be invoiced(30 day payment terms) prior to the site being moved into the live environment.

Copyright and Trademarks

The client is responsible for all content ( eg.images,font,copy) and Cubesedge (or sub contractors), under no circumstances will be liable from any claim or suit arising from use of content supplied by the client.

The client agrees to fully indemnify Cubesedge and hold free from harm in any and all claims resulting from the customer in not having obtained all the required copyright,and/or any other necessary permissions

Once a design has been finalised and supplied to the client, the client will gain full copyright of the final design. Cubesedge retain the copyright on all rejected and interim designs and the right to use the final design in our online and offline portfolio for promotional purposes.
